1. Agreement to Terms

Welcome to LandWise. By accessing or using our website (landwise.com) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of the updated Terms.

2. Services Description

LandWise provides land intelligence services including:

• Land assessments and analysis
• Drone surveying and aerial photography
• 3D terrain modeling and visualization
• Topographic surveys
• Land visibility studies
• Site preparation consulting

3. Service Packages and Pricing

3.1 Early Access Pricing

We offer limited-time early access pricing while building our portfolio. Early access prices are subject to availability and may be discontinued at any time without notice.

3.2 Service Scope

Each package includes specific deliverables as outlined on our website. Additional services or requests beyond the package scope may incur additional charges.

3.3 Free Land Quick Check

Our Free Land Quick Check is a courtesy service providing a preliminary assessment. It is not a substitute for a full land survey or professional due diligence. We make no guarantees about the accuracy or completeness of the quick check.

4. Booking and Payment

4.1 Booking Process

Service bookings are confirmed upon receipt of payment or execution of a service agreement. We reserve the right to decline service requests at our discretion.

4.2 Payment Terms

• Payment is typically required upfront or as specified in your service agreement
• Prices are quoted in Thai Baht (THB) unless otherwise specified
• Additional expenses (travel to remote locations, specialized equipment) will be communicated before work begins

4.3 Cancellation and Refunds

By Client: Cancellations must be made at least 48 hours before scheduled service. Refunds are subject to a 20% administrative fee. Cancellations within 48 hours are non-refundable.

By LandWise: We may cancel services due to weather, safety concerns, or other unforeseen circumstances. In such cases, you will receive a full refund or the option to reschedule.

5. Service Delivery

5.1 Timeline

Delivery timelines are estimates and may vary based on weather, site accessibility, and project complexity. We will notify you of any significant delays.

5.2 Site Access

You are responsible for ensuring we have legal access to the property. You must obtain any necessary permissions from property owners or authorities.

5.3 Weather Dependency

Drone operations are weather-dependent. Service may be rescheduled due to adverse weather conditions without penalty to either party.

6. Intellectual Property

6.1 Deliverables

Upon full payment, you receive a non-exclusive, non-transferable license to use the deliverables (maps, models, reports) for your personal or business purposes related to the surveyed property.

6.2 LandWise Rights

We retain the right to use project images, data, and outputs for marketing, portfolio, and promotional purposes unless you specifically request confidentiality (additional fees may apply).

6.3 Restrictions

You may not resell, redistribute, or commercially exploit our deliverables without written permission.

7. Warranties and Disclaimers

7.1 Professional Services

We provide professional land intelligence services using industry-standard equipment and methods. However, our services are NOT:

• Legal surveys for property boundaries or titles
• Engineering design or structural analysis
• Environmental impact assessments
• Official government-approved documentation

7.2 Recommendations

Any recommendations or assessments we provide are for informational purposes only. You should consult with licensed professionals (engineers, architects, lawyers) before making property decisions.

7.3 No Warranty

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• LandWise shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific service
• We are not responsible for decisions you make based on our reports or recommendations

You agree to indemnify and hold LandWise harmless from any claims arising from your use of our services.

9. Privacy and Data

Your use of our services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

10. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, government actions, strikes, pandemics, or equipment failures.

11. Governing Law

These Terms are governed by the laws of Thailand. Any disputes shall be resolved in the courts of Surat Thani, Thailand.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and LandWise.
